Status of repose vs status of limitation

Hello,

I am Studying for the PCM and I am a bit confuse with the status of repose vs status of limitation. Can someone help to clear my confusion with an clear example?

Welcome to the Black Spectacles Community @cragecc63! Thanks for writing in with your question.

A statute of limitations gives a specific generic window (typically 3–10 years) to file a claim. Even if someone knows about an issue early (like during construction), they can wait and file closer to the end of that period.

A statute of repose, adds stricter conditions as it sets a window after the time an issue is discovered. This typically has a much shorter window (i.e. 2 years from when the issue is known) and also sets a hard cutoff tied to project completion (i.e. 6 years after substantial completion).

Refer to The Architect’s Handbook of Professional Practice (15th Edition) page 176 for more information about these concepts.

Hope this helps!
