This question I also was debating between suety and subcontractors. I was reading carefully and they asked- which party FINISHES the job. I can argue that is has to be subcontractors- if they are free ( they should still be free if the halt is for just a bit), or other subcontractors. But I understand that the responsibility is the surety to have it finished by subcont. What is the hint here that is showing the answer to be surety?
@sevanb This is another classic exam wording challenge. The key is how the practice question uses the word finishes and the phrase: “The project contract requires a performance bond.” That tells you the question is asking about legal responsibility, not who physically does the work.
Surety is the party responsible for completion once the contractor defaults. The surety may hire the same subcontractors or new ones, but they are acting under the surety’s obligation, not their own.
So even though subcontractors may physically perform the work, they are usually not the answer unless the question explicitly asks who performs construction labor. The exam almost always asks who is contractually responsible.
