Substantial and Final Completion

This is a topic that came up in last Sunday’s workshop:

Regarding the Certificate of Substantial Completion - Is there a reasonable timeframe within which work to be completed or corrected needs to be finished?

Punch items listed on the Certificate of Substantial Completion must be completed prior to final payment. However, there is no specific time frame in days, such as 15, 30 or 60 days, but it is in the contractor’s best interest to complete the items as soon as possible. The agreed upon date for those items to be completed will be listed on the Certificate of Substantial Completion.

Please note that the start of the warranties for those items will be the date of issuance of the final Certificate of Payment or the date of final payment, whichever occurs first.

Can you clarify the time of warranty begins? According to A112 9.2.3, warranties required by the CDs shall commence at Substantial completion. A101 9.4 does not clarify that.- Thank you!

Please refer to A201 9.8.4 - “Warranties required by the Contract Documents shall commence on the date of Substantial Completion of the Work or designated portion thereof unless otherwise provided in the Certificate of Substantial Completion.”
